How Much Time Do I Have to Appeal a Long-Term Disability Claim?

The first thing that someone should do if their ERISA benefits claim has been denied or if they already have benefits that have been terminated is to contact experienced ERISA attorneys, such as those of us at the Garner firm. And the reason for that is that you have a very limited amount of time to appeal a denial or termination of your benefits. In the case of a short-term or long-term disability benefits claim, you typically have 180 days from the time that you received the denial or termination letter to submit an appeal. And that does not allow very much time to compile all of the medical records, documentation, and other supporting information that’s needed in order to submit an appeal. In the case of a denial of pension benefits or life insurance benefits, you have an even shorter amount of time. You only have 60 days from the time that you receive the denial letter to submit an appeal.
